Terms of Service
Draft pending legal review. Placeholders are set on launch.
Effective date: [EFFECTIVE_DATE]
These Terms govern your use of the automated video localization service (the "Service"), which is operated by an individual operator (not a company). "We"/"us" refers to that operator. By using the Service you agree to these Terms.
1. The Service
The Service is an automated, offline production pipeline: you upload a video or paste a platform link, choose a target language and options, and we generate a localized version (AI dubbing + subtitles + a review report). The Service is not a manual timeline editor; it is intentionally automated, and certain advanced tiers (high-fidelity lip-sync, anime/film tier, voice cloning, API/white-label) are on our roadmap or in beta and are not guaranteed or for sale unless explicitly offered.
2. Your content & rights (you must own the rights)
- You are solely responsible for the videos you upload or retrieve via platform links, and for all persons, voices, brands, trademarks, music, and other materials in them.
- You represent and warrant that you own or have all necessary rights, licenses, and consents to upload, process, and create localized versions of that content, including the rights of any individuals appearing or speaking in it.
- You must not use the Service for content that is infringing, defamatory, illegal, or that violates others' rights or privacy.
- We may remove content or suspend accounts that violate these Terms.
3. Platform links (抓取 disclaimer)
- The platform-link feature retrieves a source video at your direction from a URL you provide. You are responsible for ensuring you have the right to download and use that video. We are not affiliated with, endorsed by, or an official partner of TikTok, YouTube, 抖音, or any platform, and you must comply with each platform's Terms of Service and applicable copyright law.
- We attempt to retrieve a low-interference/clean source but do not guarantee a watermark-free result. If a clean source cannot be obtained, it is flagged in the review report. We make no representation that downloading from a given platform is permitted in your situation.
4. AI dubbing & voice cloning
- Dubbing and subtitles are AI-generated (synthetic). Output quality is best-effort; we provide a review report and a
needs reviewstatus to help you verify, but we do not guarantee 100% accuracy of translation, dubbing, or timing. - Voice cloning (beta): You may only clone a voice that is your own or for which you have obtained the voice owner's explicit, documented consent. You must not impersonate any person or clone a third party's voice without authorization. You are liable for unauthorized voice cloning.
- You must not use AI-generated voice/video to deceive, impersonate, defraud, or create unlawful deepfakes.
4a. AI-generated content labelling (provider & user obligations)
- Synthetic output. The audio and video this Service produces are AI-generated synthetic content; cloned-voice output is synthetic speech. Applicable law imposes labelling/transparency obligations on the provider of synthetic media — including China's *Measures for Labelling AI-Generated and Synthetic Content* (effective 2025-09-01, requiring both an explicit and an implicit/metadata label) and EU AI Act Article 50 (machine-readable marking of synthetic audio/video and deepfake disclosure).
- What we do. Where applicable law requires it, we apply, or will apply, an explicit (human-perceptible) and an implicit (machine-readable/metadata) AI-generation label to the output. See Privacy §6a for details and current implementation status.
- No tampering with labels. You must not remove, disable, alter, or obscure any AI-generation label, watermark, or metadata marker that we apply to your output.
- Your downstream disclosure. When you publish or distribute the output, you remain responsible for any AI-disclosure or deepfake-disclosure required by the platform or jurisdiction you publish into. Our labelling does not discharge your own publishing-side disclosure duties.
4b. Data retention & your download window (source deleted on completion; output ~7 days)
You must not use the Service to: infringe IP or platform ToS; create non-consensual, deceptive, or harmful deepfakes; process content depicting minors unlawfully; generate hate, harassment, or illegal content; circumvent the automation contract (no manual per-segment/per-frame tampering — the system enforces this); or resell the Service except under an authorized agency/bulk arrangement.
- We do not store your media long-term. Your source video and intermediate products are deleted as soon as the job completes and are not retained; the final output (video + subtitles + report) is kept for approximately 7 days, after which it is automatically deleted (you can also delete it yourself at any time). See Privacy Policy §4.
- Download within ~7 days. Your output is available to download or re-download for approximately 7 days. After it expires (~7 days), the output is automatically deleted and cannot be recovered; we do not keep a longer backup. The source is not retained, so a source-level re-run requires you to re-upload.
- Re-run / trace-back is limited to the output retention window. Because the source is deleted on completion and we keep no long-term copy, tracing back a problem or re-running against the kept output is only possible within the output's ~7-day window; a source-level re-run requires re-upload because the source has already been deleted. We do not promise to retrieve, restore, re-send, or re-run any job after its data has been deleted. We are not liable for output you did not download in time.
6. Roadmap & beta features
Features labeled roadmap/beta/coming-soon (e.g. lip-sync premium tier, anime/film tier, voice cloning, agency API/white-label) may be unavailable, change, or be withdrawn. We do not warrant their availability and do not currently sell features that are not released.
7. No guarantee of outcomes
We do not guarantee any business outcome (e.g. conversions, sales, market results). The Service is provided to help you produce multilingual video; results depend on your content and use.
8. Disclaimers & limitation of liability
The Service is provided "as is" and "as available", without warranties of any kind to the extent permitted by law. To the maximum extent permitted by applicable law, the operator is not liable for indirect, incidental, special, or consequential damages, or for loss of data, profits, or goodwill, arising from your use of the Service — including any output you failed to download within the ~7-day output retention window (see §4b). Some jurisdictions do not allow certain limitations; those limits apply only as permitted.
9. Indemnity
You agree to indemnify the operator against claims arising from your content, your violation of these Terms, or your infringement of any third-party right (including platform ToS, copyright, voice/likeness rights).
10. Fees, plans & refunds
Paid plans, free allowances, and the agencies/bulk plan are described on the pricing page. Refunds are governed by our Refund Policy. [待03定价:具体套餐、计费维度、免费额度]
10a. Payment processing & invoices (please read)
- Payment is not yet enabled. The Service is currently free; no paid checkout is live. This section describes how billing will work once paid plans open.
- Third-party processing. When paid plans open, payments will be processed by
[支付处理方]. International methods (card / PayPal, or a merchant-of-record such as Creem) are handled by the respective processor; Alipay / WeChat Pay may be collected through a third-party aggregation service settling to a personal account rather than a registered company merchant account. The payment processor is a separate entity governed by its own terms and privacy practices; see our Privacy Policy §3. - Invoices — honest disclosure. For payments collected via a personal/aggregation channel, we cannot issue a VAT invoice (增值税发票) or a formal company invoice (发票), and we do not promise to do so. At most we can provide a payment confirmation / receipt. Business customers who require a formal invoice for accounting should confirm available documentation before purchasing. Where a merchant-of-record processes the payment, that processor may issue its own receipt/invoice under its name.
- Refunds. Refund routing for these channels is described in the Refund Policy §0a (original method/channel where possible; manual processing for personal-aggregation channels). Nothing here adds any warranty of payment-service availability.
11. Termination, governing law, changes
We may suspend or terminate access for violations. The Service is run by an individual operator; these Terms are governed by the laws of the operator's place of residence (Mainland China; specific province/city: [GOVERNING_LAW_REGION:具体省市待定]), without prejudice to any mandatory consumer-protection rights you have under your local law (需法务终审). We may update these Terms and will post the new effective date. Contact: support@aivideotranslator.co.
